These Terms & Conditions (“Terms”) govern your access to and use of the Fomo mobile application and website (collectively, the “Platform”), operated by Fomo (“we”, “us”, “our”). Please read these Terms carefully before creating an account or using any feature of the Platform.
By tapping “I Agree”, creating an account, or using the Platform in any way, you confirm that you are at least 18 years old, have the legal capacity to enter into a binding contract, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the Platform.

About Fomo and Our Role
Fomo is a peer-to-peer secondary ticket marketplace that enables individuals to list, discover, and arrange the transfer of tickets for live events in India, including concerts, music festivals, stand-up comedy shows, and sporting events.
Fomo acts as an intermediary platform under Section 2(1)(w) and Section 79 of the Information Technology Act, 2000. Fomo does not own any tickets listed on the Platform. Fomo is not a party to any transaction between a buyer and a seller. We facilitate the connection; the contract of sale is solely between the buyer and the seller.
What Fomo Verification Means
Our verification process reviews tickets before listings go live to reduce the risk of fake screenshots, duplicate QR codes, and relisting scams. A “Fomo Verified” label indicates that at the time of review, the ticket appeared genuine. It does not constitute a guarantee of entry, a warranty of fitness, or an endorsement of the seller. Verification is a risk-reduction measure - not an insurance product.

Eligibility
You must be at least 18 years of age to create an account or use the Platform.
You must be legally capable of entering into binding contracts under Indian law.
If you are accessing the Platform on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
Fomo reserves the right to refuse registration or access to any person or entity at its sole discretion.

Account Registration & Security
3.1 Account CreationTo list or purchase tickets, you must create an account by providing accurate, complete, and current information. You are responsible for ensuring your account information remains accurate and up to date.
3.2 Account SecurityYou are responsible for maintaining the confidentiality of your account credentials. You must not share your password with any third party. Fomo will not be liable for any loss or damage arising from unauthorised access to your account resulting from your failure to keep your credentials secure.
3.3 Account Termination by YouYou may delete your account at any time via the app’s account settings or by contacting fomo.owner@gmail.com. Deletion is subject to our data retention obligations as set out in the Privacy Policy.
3.4 Suspension by FomoFomo may suspend, restrict, or terminate your account at any time, with or without notice, if we determine you have violated these Terms, engaged in fraudulent activity, or otherwise acted in a way that is harmful to other users or the Platform.

Listing Tickets - Seller Obligations
4.1 Accuracy & Honesty
By listing a ticket on Fomo, you represent and warrant that:
You are the lawful owner of the ticket or are authorised by the lawful owner to sell it.
All information provided in the listing is accurate, complete, and not misleading.
The ticket is genuine, unused, and valid for the event stated.
The ticket has not been simultaneously listed on any other platform (double-listing is prohibited).
The ticket is not subject to any dispute, chargeback, or cancellation with the original issuer.
4.2 Compliance With Original Ticket TermsSellers are solely responsible for ensuring their resale complies with the terms and conditions of the original ticket issuer (e.g., BookMyShow, District, or the event organiser). Violations of original ticket T&Cs - including reselling non-transferable tickets - may result in the ticket being cancelled by the organiser. Fomo bears no liability for such cancellations.
4.3 Verification SubmissionSellers must submit the required verification materials (typically the booking confirmation email or ticket screenshot) to enable Fomo’s pre-listing verification. Submission of false or manipulated verification materials constitutes a serious breach of these Terms and may attract legal action.
4.4 PricingSellers may set their own asking price. Sellers in Maharashtra should be aware of the Maharashtra Entertainments Duty Act, 1923, which restricts resale of certain tickets above face value. Fomo does not cap prices nationally but reserves the right to flag or remove listings that appear exploitative or in breach of applicable law.
4.5 Removal of Sold TicketsOnce a ticket has been sold and transferred, sellers must promptly remove or mark the listing as sold. Failure to do so - resulting in a buyer attempting to purchase an already-sold ticket - may result in account suspension.

Buying Tickets - Buyer Obligations & Risks
5.1 Buyer Responsibility
By purchasing or agreeing to purchase a ticket via Fomo, you acknowledge that:
You are entering into a direct contract with the seller, not with Fomo.
Fomo’s verification reduces risk but does not eliminate it entirely. You remain responsible for your own due diligence before completing payment.
You should review listing details carefully and use the in-app chat to ask questions before committing to a purchase.
5.2 PaymentPayment for tickets is made directly between buyer and seller, currently outside the Fomo Platform (via UPI, bank transfer, or other agreed methods). Fomo does not process, hold, or intermediate any payment. Fomo is not responsible for payment disputes, failed transfers, or non-reversible payments.
5.3 Non-Transferable & ID-Restricted TicketsSome event organisers issue tickets that are non-transferable or require the original buyer’s government-issued ID at entry. Buyers are advised to verify transfer eligibility with the seller before payment. Fomo is not liable for denied entry resulting from ID-linked or non-transferable ticket restrictions.
5.4 Promoter TicketsSome listings on Fomo are promoter tickets - tickets sourced from official organiser-aligned offline partners. These tickets are genuine but may not appear on primary ticketing websites. Delivery timelines for promoter tickets may be longer, and delivery methods may differ (direct account transfer, e-ticket, or physical wristband). These specifics are disclosed on each promoter listing.

In-App Chat - Usage Rules
Fomo provides an in-app messaging system for buyers and sellers to communicate. By using this system, you agree:
Not to use the chat to harass, threaten, intimidate, or abuse other users.
Not to use the chat to distribute spam, unsolicited promotions, or malware.
Not to share fake, misleading, or fraudulent ticket information in chat.
Not to request or share sensitive personal information (government IDs, financial account details, passwords) via chat.
To accept that Fomo stores chat messages on secure servers and may access them in cases of disputes, fraud investigations, or valid legal orders, as described in our Privacy Policy.
To accept that violation of these chat rules may result in account suspension and, where the conduct is unlawful, referral to law enforcement.

Prohibited Conduct
You must not use the Platform to:
List, sell, or distribute fake, duplicated, stolen, or altered tickets
Use automated bots, scripts, or software to scrape, bulk-list, or manipulate the Platform
Create multiple accounts to circumvent suspensions or restrictions
Impersonate another user, business, or public figure
Engage in any form of fraud, deception, or misrepresentation
List tickets in violation of the original issuer’s T&Cs where you know such violation voids the ticket
Violate any applicable Indian law or regulation
Interfere with or disrupt the Platform’s infrastructure, servers, or networks
Attempt to reverse-engineer, decompile, or extract the source code of the app

Intellectual Property
8.1 Fomo’s IPThe Fomo name, logo, design, code, content, and all Platform features are the intellectual property of Fomo and are protected by applicable Indian and international IP laws. You may not copy, reproduce, distribute, or create derivative works from any Fomo IP without our prior written consent.
8.2 User ContentBy posting a listing or sending content on the Platform, you grant Fomo a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content solely for the purpose of operating and promoting the Platform. You retain ownership of your own content.
8.3 Third-Party ContentListings must not include copyrighted images, artist photographs, event artwork, or other materials belonging to event organisers or third parties without authorisation. Fomo will remove listings that infringe third-party intellectual property rights upon receiving a valid takedown notice.

Disclaimer of Warranties & Limitation of Liability
9.1 Platform Provided “As Is”
The Fomo Platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Fomo Is an Intermediary
Fomo is not responsible for:
The accuracy of seller listings
The performance of sellers
The quality or validity of tickets
Denied entry at events
Event cancellations or rescheduling
Disputes arising between buyers and sellers
Your transaction is with the seller, and your contract is with the seller.
9.3 Limitation of LiabilityTo the maximum extent permitted by applicable Indian law, Fomo’s total aggregate liability to you for any claim arising out of or related to the Platform shall not exceed INR 1,000 (One Thousand Rupees). Fomo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
9.4 ExceptionsNothing in these Terms limits Fomo’s liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by Indian law.

Indemnification
You agree to indemnify, defend, and hold harmless Fomo and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
Your use of the Platform
Your violation of these Terms
Your listing or purchase of tickets
Your violation of any third party’s rights, including intellectual property rights
Any content you submit to the Platform

Dispute Resolution Between Users
11.1 Between Buyers and SellersIn the first instance, buyers and sellers are expected to attempt to resolve disputes directly via the in-app chat. If this is not possible, either party may raise a formal complaint with Fomo’s support team at fomo.owner@gmail.com, providing transaction details and relevant chat evidence.
11.2 Fomo’s Role in DisputesFomo will review the complaint and the relevant evidence (including, where necessary, in-app chat logs) and provide a recommendation to assist resolution. Fomo’s involvement is advisory and facilitative - Fomo is not an arbitrator or adjudicator and cannot compel either party. Where fraud is evident, Fomo will take action against the offending user’s account and may refer the matter to law enforcement.
11.3 Consumer ForumNothing in these Terms prevents you from filing a complaint with the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or approaching any other competent authority under Indian law.

Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform that is not resolved amicably shall be subject to the exclusive jurisdiction of the courts located in Kolkata, India.

Changes to These Terms
Fomo reserves the right to update or modify these Terms at any time. When we make material changes, we will notify you via in-app notification or email and update the “Last Updated” date. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using the Platform.

Miscellaneous
14.1 Entire AgreementThese Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Fomo regarding your use of the Platform.
14.2 SeverabilityIf any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable. All other provisions will remain in full force and effect.
14.3 WaiverFomo’s failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.
14.4 No PartnershipNothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and Fomo.
