This Privacy Policy explains what data we collect, why we collect it, how we use it, and your rights over it when you use the Fomo mobile application and website (collectively, the “Platform”).
By creating an account or using the Platform, you acknowledge that you have read and understood this Privacy Policy and agree to its terms. If you do not agree, please stop using the Platform immediately.
A Note on Our Chat System
Fomo has transitioned from a WhatsApp-facilitated communication model to an in-app messaging system. All conversations between buyers and sellers now take place within the Fomo Platform. Messages are stored on our secure servers and are accessible to Fomo’s authorised personnel only in limited circumstances described in this Policy - primarily for dispute resolution, fraud prevention, and legal compliance.
Information We Collect
We collect information in three ways: information you provide directly, information generated automatically by your use of the Platform, and information from third parties where applicable.
1.1 Account & Profile Information
- Full name and display name
- Email address
- Mobile number (used for account verification and notifications)
- Profile picture (optional)
- Password (stored in encrypted/hashed form - never in plain text)
1.2 Ticket Listing Information
When you list a ticket for sale, you provide:
- Event name, date, venue, and ticket category
- Number of tickets and asking price
- Ticket type (e-ticket, wristband, physical, app-based transfer)
- Ticket confirmation email or booking confirmation (submitted for verification purposes only)
Important - Ticket Verification Emails: Confirmation emails you submit for ticket verification are processed solely for the purpose of verifying the ticket’s authenticity.
1.3 In-App Chat & Communication Data
Fomo provides a built-in messaging system for buyers and sellers to communicate directly within the Platform:
- All messages sent via Fomo’s in-app chat are stored on our secure servers.
- Message content, timestamps, and participant identifiers are retained.
- Fomo does not routinely read, monitor, or analyse individual chat conversations.
Chat data is accessed by authorised Fomo personnel only when:
- A dispute, complaint, or objection is formally raised by a user through the Platform’s dispute resolution mechanism
- Investigating potential fraud, scams, fake listings, or platform policy violations
- Required by a valid legal order, court direction, or regulatory authority
Chat logs may be used as evidence in investigations and are subject to Fomo’s data retention schedule described in Section 9.
1.4 Transaction & Activity Data
- Listings viewed, bookmarked, or enquired about
- Events followed and alerts configured
- Seller and buyer activity history on the Platform
- Reports submitted (e.g., reports of suspicious listings)
1.5 Automatically Collected Technical Data
- Device model, operating system version, and app version
- IP address and approximate location (city/region level)
- Unique device identifiers and advertising identifiers (where applicable and permitted)
- Log data: pages visited, features used, time spent, error logs
- Push notification tokens (to send event alerts you have opted into)
1.6 Payment-Related Information
Fomo does not currently process payments directly on the Platform. Transactions occur peer-to-peer between buyers and sellers. We do not collect, store, or process credit/debit card numbers, UPI IDs, or bank account details. If payment processing is introduced in future, this Policy will be updated and you will be notified.
How We Use Your Information
2.1 Core Platform Functionality
- Creating and managing your account
- Processing and displaying ticket listings
- Operating the in-app messaging system
- Sending event alerts and push notifications you have opted into
- Enabling ticket verification before listings go live
2.2 Trust, Safety & Fraud Prevention
- Verifying ticket authenticity before listing publication
- Detecting and investigating fake listings, duplicate QR codes, and relisting scams
- Reviewing chat communications when a formal dispute or objection is raised
- Taking action against users who violate our policies
- Maintaining the integrity of the verified listings system
2.3 Legal Compliance
- Complying with applicable Indian laws and regulations, including the IT Act, 2000, Consumer Protection Act, 2019, and relevant state laws
- Responding to valid legal requests, court orders, or directions from law enforcement or regulatory authorities
- Maintaining records as required by law
2.4 Platform Improvement
- Analysing aggregate, anonymised usage patterns to improve features and performance
- Conducting internal research to develop new features (e.g., community, attendance badges)
- Diagnosing technical issues and bugs
2.5 Communication
- Sending transactional notifications (e.g., listing status updates, dispute outcomes)
- Sending product announcements and feature updates (you can opt out at any time)
- Responding to customer support requests
In-App Chat - Detailed Data Policy
Given that our chat system is a core feature of the Platform, we provide additional detail on how chat data is handled.

Access to chat data is strictly controlled:
- Messages are NOT visible to general Fomo staff or support agents as part of routine operations.
- Access is granted only to specifically authorised personnel on a need-to-know basis.
- All internal access to chat data is logged and audited.
3.3 When Chat Data Is Accessed
Fomo will access chat content only in the following circumstances:
- A user formally raises a dispute, complaint, or objection through the Platform’s dispute resolution system. In such cases, we may review the relevant chat thread as part of investigating the matter.
- We have reasonable grounds to suspect fraud, fake ticket distribution, scam activity, or a serious violation of our Terms of Service.
- We receive a valid legal order, warrant, or regulatory direction requiring disclosure.
- It is necessary to protect the safety of a user or a third party in an emergency.
We will not access, read, or analyse chat content for advertising, profiling, selling to third parties, or any commercial purpose beyond the above.
3.4 User Responsibility in Chat
Users are responsible for the content they send via the in-app chat. You must not:
- Share sensitive personal information such as full government ID numbers, financial account details, or passwords in chat
- Use the chat to harass, threaten, or defraud other users
- Share or request the sharing of copyrighted content in violation of applicable law
Data Security
We implement industry-standard technical and organisational security measures to protect your personal information, including:
- TLS encryption for all data in transit
- Encryption at rest for sensitive data, including chat messages and user credentials
- Password hashing (bcrypt or equivalent - plain-text passwords are never stored)
- Access controls and role-based permissions limiting who can access personal data
- Regular security reviews and vulnerability assessments
- Audit logs for internal data access events
No method of transmission over the internet or method of electronic storage is 100% secure. While we take significant precautions, we cannot guarantee absolute security. In the event of a data breach that poses a risk to your rights and freedoms, we will notify affected users and relevant authorities as required by applicable law.

As a user of the Fomo Platform, you have the following rights over your personal data:
Cookies & Tracking Technologies
Our mobile app does not use browser cookies. However, we may use equivalent technologies including:
- Device identifiers and advertising IDs (IDFA on iOS, GAID on Android) to measure app performance and, where applicable, deliver relevant content
- Session tokens to maintain your logged-in state
- Analytics SDKs (e.g., Firebase Analytics) to understand aggregate app usage
You can limit the use of advertising identifiers through your device’s privacy settings (iOS: Settings > Privacy & Security > Tracking; Android: Settings > Google > Ads). Our website may use standard analytics cookies; you will be presented with a cookie consent notice on first visit.
Children’s Privacy
The Fomo Platform is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you are a parent or guardian and believe your minor child has created an account on Fomo, please contact us at fomo.owner@gmail.com and we will promptly delete the account and associated data.
Data Retention
We retain your personal data for as long as necessary to provide the Platform’s services and comply with our legal obligations. Specific retention periods:

Third-Party Links & Services

This Privacy Policy does not apply to those platforms. We encourage you to read the privacy policies of any third-party services you use. Fomo is not responsible for the privacy practices of third parties.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. When we make material changes, we will:
- Post the updated policy in the app and on our website
- Update the “Last Updated” date at the top of this document
- Send you an in-app or email notification for significant changes
Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Privacy Policy.
